My Background

Education: Bachelor of Arts and Law, University of NSW (Sydney), 1989 College of Law (Sydney) 1989

Legal experience: I was admitted to the Supreme Court of New South Wales in 1989 and the Federal and High Courts of Australia in 1990. I have practiced in New South Wales, the ACT, Victoria, the Northern Territory as well as in Western Australia.

Courtroom experience: Supreme Court, District Court, Magistrates Court, the State Administrative Tribunal, the Federal Court and Federal Magistrates Court.

I also practice extensively in the Western Australian Building Commission handling construction and construction contract disputes, as well as defending trades people against prosecutions brought by the Department of Mines, Industry Regulation and Safety.

Fees are typically based on a costs agreement. In appropriate cases, I may negotiate a fixed costs agreement, depending on the legal services you require. Under a fixed agreement, costs remain the same regardless of the work required. All costs (both cost agreement estimates and fixed costs) are quoted up front, with no obligation should you choose not to proceed.

Disputing Wills and Trusts Cottesloe

Most people understand that a will may be challenged in circumstances of unfairness or unreasonableness on the part of the maker of a will, in terms of how beneficiaries have been provided for, if at all. Perhaps fewer people know that a trustee may be removed from office for misconduct or mismanagement by order of the Supreme Court.

The removal of a trustee is not lightly ordered and may have profound consequences for trust beneficiaries in terms of the ongoing administration of the trust and the benefits they may receive. I act for both beneficiaries and trustees in prosecuting and defending claims by beneficiaries against trustees, whether of a will created trust, a discretionary or family trust or more business-oriented trusts such as superannuation or unit trusts.
